Registering a Sale Deed in Bangalore: Which Sub-Registrar Office, and How Soon

Buyers of a flat or plot in Bangalore often assume the nearest sub-registrar office will do. In law the answer depends on where the property is and on a handful of statutory deadlines. The notes below cover jurisdiction under the Registration Act, 1908, the anywhere registration option, timing and attendance.

Why Location of the Property Matters Most

The 1908 Registration Act, in its section 28, sends a document about land or buildings to the sub-district in which the property is, wholly or partly. Where the parties live is irrelevant, and so is the town of signing.

Each sub-registrar office in Karnataka has its own territory of wards, villages and survey numbers. A Whitefield flat is therefore handled by the office covering that eastern area, whatever the owners' own neighbourhood. With one office per property, lenders and later buyers can trace the whole deed history in one search.

What Anywhere Registration Allows

Anywhere registration lets a deed be taken to any sub-registrar office in the property's registration district, not only the home office. The Bangalore districts had the facility for several years, and it covers the entire state from 2 September 2024.

This spreads demand across offices. If the home office has no slot for days, a buyer can use a less busy one in the district and complete the process sooner. Since all offices share the Kaveri 2.0 platform, the entry reaches the right index either way.

The District Boundary

Offices outside the property's district stay off limits. Bangalore has five registration districts named after their headquarters, which are Gandhinagar, Shivajinagar, Basavanagudi, Jayanagar and Rajajinagar. Each includes more than one sub-registrar office.

Confirming the Permitted Offices

The Kaveri 2.0 website resolves the doubt while the application is filed. After the e-khata number or survey number of the property is keyed in, the transaction is tied to the correct district, and only permitted offices show when a slot is booked.

Rely on that list over second-hand advice, as jurisdictions change when new offices open. A separate guide of ours lists the online steps for booking on Kaveri 2.0. If doubt remains, the home sub-registrar can confirm the district before any fee is paid.

How Long a Signed Deed Stays Valid for Registration

Section 23 requires the deed to be presented within four months of execution, counted from the day of signing. A will is the usual exception, and it carries no such limit.

  • Within four months: normal presentation, once stamp duty and registration charges are paid
  • Extra time of up to four months: the District Registrar may pardon the delay under section 25 for urgent necessity or unavoidable accident, with a penalty up to ten times the registration charge
  • Later than that: no registration is possible, and fresh signatures are needed
  • Deed signed outside India: under section 26, the four months run from its arrival in India

Kaveri 2.0 usually combines signing and registration into a single visit, so slippage is uncommon. It tends to affect papers signed beforehand, or by a party abroad. Under section 17, registration is compulsory when immovable property valued at Rs. 100 or above is sold, and without it ownership does not pass.

Personal Appearance and Agents

Section 32 names who can present a document, while section 34 expects its signatories to be there in person. In a sale, every buyer and seller named in the deed attends. The registering officer checks identity and willingness to sign, a protection against impersonation.

When a party cannot come, an agent with a power of attorney may act in place of that party under section 33:

  • Principal living in India: the power of attorney is signed in the presence of the Registrar or Sub-Registrar for the principal's home area, who authenticates it
  • Principal living abroad: it is signed before a notary, a court or a consular officer of India, and stamped in India once it arrives
  • Scope: the document must spell out the particular acts, for instance presenting the deed and accepting that it was executed

Most NRI transactions follow the overseas route. Under section 31 the officer may also attend a residence for special reasons, serious illness being one. Our NRI page adds guidance on purchases from abroad.

A Deed Taken to the Wrong Office

An office can decline a property outside its area. Since Kaveri 2.0 offers slots only at permitted offices, most errors are caught early, and the cost is normally one lost working day plus a rebooking.

Resale buyers should look hard at old paper deeds. A deed registered at an office with no power over the land can be challenged, and courts consider a token extra property, added only to gain jurisdiction, a deception of the registration system. The title lawyer ought to check each link of the chain.

Before You Book the Slot

A short checklist saves a repeat visit:

  1. Pull out the survey number or e-khata number, the village or ward and the office named in the seller's previous deed
  2. Identify the district of registration and restrict the shortlist to offices within it
  3. Fix a date when all parties are in town, or get an attorney's authority authenticated early
  4. Sign and register on one day, well within four months
  5. Work out the duty and the 2% charge for registration beforehand, because a shortfall halts the appointment

For values above Rs. 45 Lakhs the Karnataka rate is 5%, or 5.6% after cess and surcharge. Use the EMI calculator to see the upfront cash at a given price. After registration the buyer takes the deed and applies to move the khata into the same name.
