Is Your Property Agent Registered? A K-RERA Check for Bangalore Buyers

New-launch buyers in Bangalore tend to hear from an agent first and the builder much later. Karnataka's regulator, K-RERA, makes registration compulsory for such agents and requires the number to feature in each sale. The sections below cover who falls under the rule, the portal check, what it can and cannot tell you, and the penalties for defaulters.

Reading the Definition

The 2016 Act casts its net wide. If you negotiate sales for others, act on their behalf or simply bring a seller and a buyer together, and money changes hands as a fee or commission, you are an agent. Brokers, dealers and middlemen are all spelled out in the text.

It makes no difference whether the agent is a sole broker, a firm of partners, a corporate entity, a builder's channel partner or an online platform paid per sale. A developer's salaried sales team is a different case, since it works for the promoter and shares the project's registration.

Section 9: The Registration Rule

Helping to sell a flat, site or building in a registered project is barred until the agent registers with the Authority. The resulting number must go on every sale facilitated. Breach of conditions, or a registration won by fraud or misstatement, can be answered by suspension or cancellation.

Applicants in Karnataka pay Rs. 25,000 if individual and Rs. 2 Lakhs if anyone else. The certificate holds good for five years, and the renewal request should reach the Authority before expiry. Brokers whose business is purely rentals do not need it, since the requirement attaches to sales in registered projects.

Running the Check, Step by Step

Allow a few minutes and no money. Complete it ahead of handing over documents or a token.

  1. Get the agent's registration number and the name printed on the certificate.
  2. Reach the agent-search page of the Karnataka RERA portal.
  3. Enter the number or, if it is not on hand, the name.
  4. Check the record's name, registrant type (individual or firm) and address against the card, stationery and receipt you hold.
  5. Confirm that the certificate's validity period includes the day of your transaction.
  6. See if the number is shown in the agent's ads, texts and booking paperwork.
  7. Search for the project as well, which must carry its own registration number.

K-RERA agent numbers include the letters AG, while project numbers include PR. An agent giving you a project number in answer has sidestepped the question. If a firm is the registrant, check that your contact really belongs to it.

Section 10 Duties in Plain Terms

Section 10 is where a buyer gains something concrete. Registered agents cannot facilitate sales in projects that should be registered but are not, and they must hold account books, records and papers in the prescribed form. They may not misstate the quality or standard of a project, nor pose as holding an approval or affiliation they lack.

Advertising services that are not meant to be offered is also barred. In addition, the buyer must be assisted in obtaining all information and documents due at booking. Under section 31, a complaint may be made against an agent in the same way as against a promoter, and the number identifies the respondent.

Reading the Result Correctly

A successful search proves registration and the obligation to follow section 10, and it tells you whom to name if you complain. It does not measure how knowledgeable the agent is or how good the advice or the property may be.

The project needs separate verification of its registration and declared completion date, its title papers, approvals and the cost sheet price from the developer, along with the agreement for sale. A statement from an agent has weight only where these documents agree.

When No Registration Exists

Section 62 punishes an agent who works unregistered or breaks section 10. The penalty runs at Rs. 10,000 per day of default, with the total capped at 5% of what the land, flat or building cost. Section 65 adds a penalty for disobeying an Authority order.

The buyer's loss is practical, because the unregistered have no regulator file and their assurances are hard to pursue. An agent who withholds the number gives you reason enough to deal with the developer or look elsewhere.

Safer Ways to Pay and to Rely on Promises

Disputes with agents nearly always begin with payments or verbal assurances. Keep to a few rules. Pay the booking amount into the project account the promoter holds with its bank, not into any individual agent's account, and insist on the developer's receipt with an allotment letter each time.

Any commitment about price, discount, floor, view or possession should be confirmed by the developer on paper. Where you owe the agent a fee, agree it in writing, though developers normally pay commission on new projects. Retain emails and messages from the agent, which serve as evidence if a statement proves false.

Resale is another matter. A resale flat in an old building generally lies outside RERA, so whether a broker's registration applies is doubtful. Protection there comes from title verification, a sound sale agreement and bank-routed payment.

First-Meeting Questions

Three things deserve a direct answer: the registration number of every project on offer, the agent's own K-RERA number, and the developer's authority for the agent to market it. Good agents reply without hesitation and follow up by email.
