Is the Clubhouse Yours? Civic Amenity Sites and Apartment Buyers in Bangalore

Most buyers assume the amenities inside a gated project belong to the residents. In Bangalore that assumption fails whenever the clubhouse is built on a civic amenity plot, because the planning authority owns that land. What follows covers the term itself, the lease that usually accompanies it, the practical effect on a flat owner, and the documents worth asking for before any payment.
Why Would Land Belong to the Authority?
Large layouts and housing projects must hand over some land for public use. The 2015 Revised Master Plan sets zoning rules for this. Ten per cent of the area is earmarked for gardens and open ground, with 5% or more kept for amenities. Sanction conditions then pass the road network, parks and amenity plots to the authority.
The 1976 statute that created the Bangalore Development Authority defines amenities by function. Covered are schools and colleges, libraries and cultural or social centres, plus hospitals, dispensaries and maternity homes. The list continues with banks, markets, post offices, bus stands, and police and fire stations, and finishes with government recreation centres.
Whose Land Is It Once Handed Over?
The authority's. As soon as the handing-over deed is registered, the plot leaves the developer's hands and drops out of the land the apartments share. A flat owner's portion of land is then reckoned on the rest of the project.
The authority can offer the plot for an approved purpose. Its 1989 rules on allotting these sites speak of a lease of 30 years, never a sale. The lessee pays an amount, follows the permitted use, and gives the plot back if conditions are broken.
The Lease-Back Route
A developer can draw the project so the clubhouse is placed on the amenity portion. The plot is handed over, then taken again on lease, held by the developer or by a company it forms. Sales material presents the building as another facility and skips the lease.
With the authority's approval of both lease and use, the practice is lawful. Residents nevertheless hold a right to use, which is weaker than ownership, however alike the buildings appear. A buyer who assumes every amenity is owned may learn otherwise only at resale, so the lease deed is best read before booking and not after possession.
How Leased and Owned Clubhouses Differ
Consider these contrasts, with the leased arrangement first:
- Land title: the authority, against all flat owners together where the building is on the project's own land
- Right of use: bound by the lease term, against permanent use as a common area
- Management: whoever the lease names, against the residents' body once the project is handed over
- Uses: only the purpose approved, against whatever the residents' own rules provide
- Costs: lease rent, renewal fees and upkeep, against upkeep alone
The gap becomes clear with time, since renewal terms rest with the authority. If the developer holds the lease rather than the residents, the community depends on the builder for years beyond the last sale.
Four Practical Consequences
The first is a smaller land base for every share. Projects with equal gross extent can give flats of identical size unequal land shares. Only the sale agreement, and not the marketing material, records the share conveyed.
The second is limited control. The association may run and maintain the building but cannot sell the land beneath it or mortgage it. If the developer holds the lease, transfer or sub-lease is required, and it requires the authority to agree.
The third concerns who may enter. Since CA land is meant to serve the public, the lease defines the users, and the facility may not be restricted to residents. The fourth is scrutiny at resale or on a loan. A lawyer reads the lease with the title papers, and a lease that is current and held by the residents' body raises few eyebrows, while an expired or contested one slows a transaction.
The 2026 Apartment Bill in This Context
Karnataka's Apartment (Ownership and Management) Bill, 2026 cleared the Assembly on 21 August and the Council three days later. The Bill places a project's community facilities among its common areas, subject to any contrary statement in the promoter's declaration. Areas listed there or on the approved plan may be reduced only with the sanctioning authority's approval.
The provisions operate from a notified date and not before. After that, the declaration shows if the clubhouse counts as shared property, though a clubhouse on CA land stays bound by its lease because the authority holds the title.
Documents to Request in Writing
Ask the developer for the items below in writing, and let a property lawyer review the replies:
- The sanctioned plan, to check if the clubhouse is within the civic amenity zone
- The deed handing the CA plot to the authority, if that has been done
- The lease deed, listing lessee, term, rent and permitted use, when the clubhouse is on such a plot
- A statement whether the lease will pass to the residents' association when the project is handed over
- The land on which the share in the draft sale agreement is computed
- The common areas displayed for the project on the state RERA portal
