Is the Flat Already Mortgaged? Using the CERSAI Registry in a Bangalore Resale Purchase

Few resale buyers in Bangalore ask the question that matters most before paying a token advance: does the seller's bank already hold this property as security? A sale deed history and a clean encumbrance certificate do not settle it. A ten-rupee online search on the lenders' central registry does, and the notes below explain how it works and what to do with the result.
Why the Usual Paperwork Can Hide a Loan
Most home loans work through an equitable mortgage, formed when the owner leaves the original deeds with the lender. The Transfer of Property Act, in Section 58(f), requires no registered document for this. Karnataka issues the encumbrance certificate through Kaveri and it lists registered documents only, so it can look spotless while a bank keeps the deeds in a locker.
A buyer who relies on the certificate alone therefore risks buying a flat that is still pledged. The registry known as CERSAI exists to record exactly this kind of charge, so the two checks work best together.
What CERSAI Is and Why Banks Use It
CERSAI is the central registry of security interests. The Government of India set it up under the 2002 SARFAESI Act, and operations began in March 2011, mainly to prevent one property from backing several lenders' loans.
Lenders file the interests they take, and each entry carries the names of borrower and lender, the property and the amount secured. Vehicles and receivables are covered too, but a buyer needs it to learn whether a property was pledged earlier.
Banks keep entries current because the Act requires filing within a month of creating an interest. Following changes made in 2016, a charge absent from the registry cannot be enforced under the SARFAESI route.
Step by Step: The Search
The official portal lets anyone make a public search. It costs ten rupees plus GST each time, payable online, and what comes back is a report of any security interests. Two types matter.
- By asset: give the address along with the state, district and the survey or site number
- By debtor: give the owner's PAN or name to see charges on all of that person's assets
The first answers the direct question, and the second helps when the seller owns multiple properties or a business that borrows. Details should be copied from the title papers and the khata. Keep each report, which shows the date of the search.
Finding a Charge: What Next?
A charge means the lender keeps its claim after the sale unless the loan is cleared and the charge formally closed. Trusting the seller to settle it later is not enough protection. A safer order of events follows.
- Request the current loan statement and a closing-amount letter from the lender
- Record in the agreement that this sum is paid straight to the lender out of the price
- Pay the lender directly, through the buyer's bank if that bank is lending
- Collect the original deeds, the no dues letter and the mortgage release
- See that the lender has recorded the closure, and run the search again
If a home loan is part of the purchase, the buyer's lender often does the takeover itself. It clears the old loan, takes the deeds and registers its own charge instead, which spares the buyer much of the paperwork.
What the Registry Does Not Show
A clean report gives real comfort without being a full guarantee. It carries only what lenders have filed, so loans never filed, or lent privately by individuals, will be absent. Court attachments, family claims and title disputes are outside its scope.
Treat the search as one layer among several.
- An encumbrance certificate spanning 30 years, from Kaveri
- Original title deeds in the seller's hands, not copies
- The khata extract with this year's tax receipt
- A lawyer's title opinion, given after reading the full chain of documents
Absent originals are often the best clue. If the deeds are with a bank, the seller offers photocopies and a story, and that is a cue to ask harder questions.
When to Search
Run the first search before any advance, while walking away is still easy. Repeat it just before registration, as a loan could be created in between. For help with a report, write to the team through the contact page.
