Late Flat Handover in Bangalore: What RERA Section 18 Lets You Claim

Late handovers are among the commonest complaints from flat buyers in Bangalore. The RERA Act deals with them in one place, Section 18, which gives the buyer a say that the developer cannot remove. This guide answers the questions buyers ask most often: what the choice is, what rate is paid, what counts as the due date and how to build a claim.
What Is the Choice?
Section 18(1) applies when a builder misses the possession date in the agreement for a flat, a plot or a building. The same applies where work halts after the builder's registration is suspended or revoked. The buyer, called the allottee, may then do one of two things.
- Withdraw from the project and get back the whole amount paid, along with interest and any compensation the adjudicating officer grants
- Stay in the project and be paid monthly interest on the money already paid, for the whole period before the flat is handed over
Withdrawal ends the booking, and the builder can resell the flat. Staying preserves the booking at the price already fixed. Section 19(4) states the refund right once more, and Section 18(2) and (3) provide compensation for title defects and other breaches by the builder.
Which Date Starts the Clock?
It is the date written in the registered agreement for sale. What a salesperson said, what the brochure showed and what a hoarding announced do not change it. A grace period counts only when the agreement states it in clear terms, and it is added first.
Many buyers compare that date with the one on the state RERA portal and find the portal later. The portal date is a promise made by the builder to the regulator, and an extension of registration changes it freely. Even so, the buyer's rights are measured from the agreement date.
What Interest Is Payable?
The rate is not open to negotiation. Karnataka's 2017 rules, in Rule 16, fix it at two percentage points above the highest marginal cost of lending rate of SBI. The benchmark changes when the bank revises it, and the rate at the date of the order is the one used.
The same rate is owed by a buyer who is late with an instalment. Clauses that charge buyers 18% a year and promise token sums per sq ft per month for delay do not fit with that rule.
A short example shows the scale. Assume the buyer has paid Rs. 1 Crore and the flat is six months late, with 11% a year used purely as an illustration. A year's interest is Rs. 11 Lakhs, so six months is Rs. 5.5 Lakhs, or about Rs. 91,667 a month.
How Does a Refund Differ?
A refund is calculated instalment by instalment. In refund cases, K-RERA orders commonly run interest from the day each payment was made till the refund reaches the buyer. On payments spread over three years, that is more than a single year of delay interest. Rule 17 says a refund that is due must be paid in sixty days with the interest.
A home loan changes the practical picture. The lender has first call on the money refunded, and the loan continues till it is closed, so instalments carry on while the matter is heard. Tell the bank in writing before filing, and ask how it wishes to receive the refund.
Should You Leave or Stay?
Each choice has a price. Leaving gives up a flat that may now be worth more, while staying ties money to a project that could slip again. These five checks help.
- See how much of the tower is built and whether labour is on site every week
- Find out whether the builder has sought the occupancy certificate
- Compare what a similar flat nearby costs today
- Look at the builder's treatment of earlier K-RERA orders, including any recovery cases
- Count how long the household can pay rent alongside a loan
A buyer who is confident of near-term completion usually stays. One who sees an idle site and mounting orders against the builder is more likely to leave.
Compensation Is Decided Separately
Interest compensates for the use of money. On top of that come items like rent paid over the added months or a costlier replacement flat, and these are claimed as compensation. The two go to different forums.
The Supreme Court settled this in Newtech Promoters and Developers v. State of Uttar Pradesh, decided in November 2021. The regulatory authority handles refund and interest, whereas compensation is for the adjudicating officer (Sections 71 and 72). The court added that a buyer's right to money back for delay is unconditional.
Can Force Majeure Be Used as a Defence?
Builders often say so, but the Act narrows it. Section 6 names war and natural calamities like earthquake, cyclone, fire, drought and flood that disturb regular development. Labour gaps, material delays, a sluggish market and pending approvals are absent from the list.
If an event on that list is established, the handover date is pushed out by its duration and the delay shrinks. The claim remains. If the buyer has unpaid dues, expect the builder to claim interest on the overdue sums.
What About the Possession Letter?
Interest earned up to handover remains due when the buyer takes the keys. Some letters say the buyer gives up all claims, and signing that line can cost the buyer the interest. Put your objection on paper and retain a copy.
A valid offer of possession includes the occupancy certificate for the tower, and without it the offer is incomplete. The day the offer is made is normally the day the delay period stops.
How to Prepare a Claim
Complaints are filed with K-RERA, the state regulator. A well-prepared file matters more than speed.
- The registered agreement, with the possession clause and any grace period marked
- A table of payments with dates, sums and receipt numbers
- Site photographs and any emails in which the builder shifted the date
- A letter to the builder stating how late the flat is and which remedy is sought, plus proof it was received
- A printout of the project's listing on the state portal, which shows registration status and past orders
The Act does not require any minimum delay before a buyer can claim. A buyer may also approach the consumer commission, as the Supreme Court has held that the remedies exist together.
