Landlord Tax in Bangalore: How Rent, Loan Interest and the 30% Standard Deduction Work

Rent earned on a Bangalore flat is reported under a heading reserved for property, and neither salary rules nor business rules govern it. The explanation below applies to the tax year 2026-27 and to a resident owner. The Income-tax Act, 2025, which took over from the earlier statute, kept the relevant provisions largely unchanged.

Who Has to Pay?

Liability rests with the owner, regardless of who collects the cheque. A flat owned by several people is split for tax: each co-owner declares a portion of the rent equal to their portion in the sale deed. Subletting income is classed with other income, and so is income from a property the taxpayer does not own.

Buildings and the ground attached to them come under this heading, while an open plot does not. An owner living overseas uses the identical method, but the tenant's withholding is far steeper.

Turning Rent Into a Taxable Number

Four steps are followed in order:

  1. Establish the gross annual value, meaning the annual rent or, if higher, what the home could reasonably earn.
  2. Take away the municipal tax the owner paid in the year; the result is the net annual value.
  3. Take 30% of that net value off as the standard deduction.
  4. Take away interest on a loan used for purchase, construction, repair or renovation.

The remainder joins total income and is charged at the applicable slab rates. If a spell of vacancy lowered the rent received, the actual rent replaces the notional figure.

The Standard Deduction

Receipts are never asked for. A flat 30% replaces every cost of keeping the home tenanted, so the real spend does not matter, whether it was Rs. 5,000 or nothing at all.

It also works the other way. Society charges, repairs, repainting, replacement fittings, brokerage, building insurance and manager fees get no separate claim. Municipal tax alone is allowed in full, when the owner pays it, and arrears settled now are counted now.

Calculation With Figures

Suppose a flat is let at Rs. 50,000 per month and Rs. 15,000 of municipal tax is paid within the year. The figures are illustrative.

LineAmount in Rs.
Rent for the year6,00,000
Municipal tax paid15,000
Net annual value5,85,000
30% deduction1,75,500
Income if no loan exists4,09,500

Tax is therefore charged on Rs. 4,09,500 rather than Rs. 6,00,000. If yearly loan interest of Rs. 6,00,000 is added, the heading shows a loss of Rs. 1,90,500, which raises the question of set-off.

Losses and the Two Tax Regimes

A rented home has no limit on the interest that may be deducted. The Rs. 2,00,000 cap that buyers often cite belongs to homes the owner lives in, and principal repaid does not enter the sum at all.

A limit applies at the next stage. Under the old regime, up to Rs. 2,00,000 of a house property loss each year can reduce salary and other income. Anything above that is carried ahead for eight years and set off only against house property income. In the example, the entire Rs. 1,90,500 would reduce salary.

Under the new regime such set-off is barred, and the loss lapses, although interest still reduces the property's rent. Owners with sizeable loans on tenanted flats should test both regimes before deciding.

Three Classes of Home

Tax treatment depends on the class a home falls in, and there are three:

  • Lived in by the owner: as many as two homes, each valued at nil.
  • Rented: a home let for any part of the year, computed as above.
  • Deemed rented: a third or later home without a tenant that the owner has not picked as their own.

A deemed-rented home is assessed on the rent it could earn though empty, and both the 30% and the interest deduction are allowed. An owner of three or more homes names the two self-occupied ones each year, and that selection moves the tax.

Tax Withheld by Tenants

Tenants withhold tax solely when rent per month is higher than Rs. 50,000. The rate is 2% for individuals and families and 10% for companies, firms and other business tenants.

An individual tenant withholds once, at the close of the tax year or tenancy, using just the landlord's PAN. With rent of Rs. 55,000 per month, annual rent is Rs. 6,60,000 and the amount withheld is Rs. 13,200, which the landlord later claims as credit.

This is a prepayment. A landlord in the highest slab pays the shortfall through advance tax or when filing. A salaried tenant claiming house rent allowance with yearly rent over Rs. 1,00,000 must supply the landlord's PAN to the employer too.

Details Often Overlooked

Five smaller points change the reported figure:

  • Separately billed charges for furnishings or appliances count as other income, with no 30% allowance.
  • A deposit meant to be returned is not income, but a sum retained for good is.
  • Rent arrears are taxed in the year they are received, after a 30% deduction.
  • Rent never paid by the tenant can be omitted if the stated conditions are met.
  • Interest paid ahead of completion is divided over five years that start at completion.

Co-owners keep separate records. Each reports a portion of the rent, takes 30% of it and claims the interest personally paid.

Records for the Return

Hold together the tenancy agreement, monthly bank credits, municipal receipts, the interest certificate from the lender and the TDS certificate from the tenant. The rent shown in the return must reconcile with the tenant's TDS statement and the annual information statement, since differences often draw a notice from the department.

This is general guidance, and a chartered accountant should review returns involving losses, co-owners or more than two homes. Before letting a flat, compare yield after both tax and loan costs. The EMI calculator shows the loan outgo, and Whitefield and other Bangalore localities help in setting price against rent.

Frequently Asked Questions

How does the tax department treat rent from a house?+
As income from house property. Municipal tax paid comes off first, then 30% of the result and any loan interest; the rest joins other income at your slab rate.
Must I produce bills to get the 30% allowance?+
No. It is granted automatically on the net annual value and replaces actual costs such as upkeep, repairs and brokerage, none of which can be deducted separately.
Is all home loan interest deductible when the flat is rented?+
Yes, and without a ceiling. If a loss results, the old regime allows Rs. 2,00,000 a year to be set against other income, with the balance carried forward eight years.
When does TDS on rent begin?+
Once rent crosses Rs. 50,000 per month. Individual tenants deduct 2%, once a year, while companies and other business tenants deduct 10%.
How many houses are self-occupied for tax purposes?+
Up to two, valued at nil. Any further house with no tenant, not picked as self-occupied, is deemed let-out and taxed on rent it might reasonably earn.
