Power of Attorney for an NRI Home Purchase in Bangalore: Clauses, Attestation, Stamp Duty

Buying a flat or plot in Bangalore while living overseas raises one practical question: who signs when the buyer cannot travel? The usual answer is a representative in India who holds a carefully drafted authority. The sections here follow the paperwork in the order it happens, from deciding on the representative to cancelling the arrangement once the home is in the buyer's hands.

The Basic Idea

A buyer can authorise someone in writing to act for them, a mechanism set out in the 1882 Powers of Attorney Act. The principal is the buyer, and the attorney is whoever the buyer chooses in India. Anything done within the authority given binds the buyer just as personal signing would.

A home purchase involves the representative in three tasks: signing the sale agreement, presenting the deed for registration and accepting possession. The property is the buyer's from start to finish, and the representative gets no interest in it. A separate risk arises when the seller holds only a general authority, because title questions then multiply.

Choosing the Representative

This person will sign binding documents and handle payments, so reliability comes before all else. Most buyers pick a parent, a sibling or a close relative based in or near Bangalore. Visits to the builder's office, the bank branch and the registration office can come up without warning, and the person must be free to go.

A poor pick is anyone who gains when the sale goes through. Developer staff and commission brokers want the deal to close, which is not always what the buyer wants. If no relative can help, a lawyer engaged directly by the buyer is a sound alternative.

Narrow or Wide Authority

A general authority covers many acts across several properties and bank accounts, while a special one covers a single named property and a stated list of acts. A purchase in Bangalore of one home calls for the special kind.

Registration offices, builders and banks read the text to find the specific act they need, so a focused deed meets less resistance. It also limits exposure should trust break down. Leave out whatever the purchase can do without.

What to Write Into the Deed

Each act should appear in plain language. For a standard purchase, the list below is usually needed.

  • Signing the agreement for sale with the seller, together with the booking form and allotment letter
  • Executing the sale deed on the buyer's behalf and submitting it at the registration office
  • Settling duty, registration charges and instalments through the buyer's bank account
  • Accepting possession, signing handover papers and collecting original documents
  • Getting khata, power and water connections and the property tax record transferred to the buyer
  • Signing loan papers and depositing the title deeds with the bank if the buyer borrows

The property needs a full description: project, tower and flat number for a flat, or village, taluk and survey number for land. Name the representative along with address and PAN. Prohibit sub-delegation so that the chosen person alone holds the authority.

Two more safeguards are worth adding. One names when the authority stops, whether a set date or completion of the purchase. The other confirms that written notice from the buyer withdraws the authority at any moment.

Signing Before Leaving It to the Courier

The rule comes from the Registration Act, 1908, for any deed of authority that supports registration of a sale. Section 33 says a principal outside India executes it before an Indian vice-consul or consul, a magistrate, a judge, a court or a notary public, and that officer authenticates it.

Two practical routes exist for buyers abroad:

  • Attend an embassy or consulate of India, where a consular officer attests the signature
  • Sign before a notary locally and add an apostille, when the country is in the Hague Apostille Convention

Australia, the United Kingdom, the United States and India are among its members. For a country outside it, the consulate route is needed. Each consulate issues its own checklist, and typical asks are a passport, photographs, witnesses and the draft, so read it before fixing an appointment.

Karnataka Stamp Duty on the Authority Itself

Indian stamp duty is not payable when the document is signed overseas. The state's 1957 stamp statute allows stamping within three months after the original first lands in India. Keep the courier slip, because it proves when that period began.

At the District Registrar's office the representative submits the original, which is examined before duty is collected. A 2023 amendment, effective 3 February 2024, replaced the Rs. 100 duty on a simple authority with a charge of Rs. 500. Documents that arrive late are treated as unstamped and attract a penalty first.

The cost of buying the home is a separate matter. For a price above Rs. 45 Lakhs the buyer pays 2% to register and 5% duty, rising to 5.6% with cess and surcharge. The representative pays these at the sale deed with funds sent by the buyer.

Loans and Money Movement

Lenders honour it for loan matters solely if those acts are named in it. Banks often want their own wording, so share the draft with the chosen lender before signing. A single deed for purchase and loan together avoids a second attestation.

Funds travel through banks, either remitted from abroad or drawn from the buyer's NRE, NRO or FCNR account. The representative can make the payments, but the money stays with the buyer. Details of our support for overseas buyers are on the NRI page, and the EMI calculator gives the monthly loan cost.

Mistakes to Prevent

A short list of errors causes most of the trouble, and each can be caught when the draft is prepared.

  • Giving wide general powers when authority limited to one property would do
  • Signing before a foreign notary with no apostille or consular attestation to make it usable in India
  • Waiting past three months after arrival before stamping in Karnataka
  • Appointing someone who earns a commission or has another interest in the sale
  • Forgetting the loan powers, an end date or a ban on delegation

Cancelling the Authority

The arrangement ends when its purpose is met or its end date comes. The buyer's death also ends it. An earlier cancellation needs a signed revocation in writing, delivered to the representative and to each office that holds a copy.

If the original had been registered, register the revocation at the same office. Copies should reach the builder, the bank and the housing society, and the original document must come back from the representative.

The article is a general guide. A lawyer in Karnataka should draft the deed and check the duty it will attract.

Frequently Asked Questions
