Joint Home Loan Tax Benefits in Bangalore: Rules for Co-Owners and Co-Borrowers

Buying with a spouse, sibling or parent usually means one loan with two names. For a flat in Bangalore, that can stretch what the lender will give, and in the old tax regime it doubles the number of deduction ceilings available to the household. Below are the roles, the tax rules, a calculation and the risks.
A Worked Example First
Picture two equal owners with a joint loan of Rs. 80 Lakhs at an interest rate of 8.5%, running 20 years. The EMI is near Rs. 69,426. In year one, about Rs. 6.74 Lakhs of the payments is interest and about Rs. 1.59 Lakhs principal.
Someone borrowing alone under the old regime could write off no more than Rs. 2 Lakhs of that interest. Shared between two, the interest is roughly Rs. 3.37 Lakhs each, and each writes off Rs. 2 Lakhs, which makes Rs. 4 Lakhs for the family. Principal claims come to nearly Rs. 80,000 each, well below the ceiling of Rs. 1.5 Lakh.
For a person in the 30% slab, the added Rs. 2 Lakhs of deduction is worth Rs. 62,400 every year after cess. Lower slabs gain less, and the gain vanishes when the new regime suits that partner better. Test other loan sizes in the EMI calculator.
Two Roles That Look Alike
An owner holds a share and is named as buyer on the sale deed. A borrower has signed the loan and answers to the bank for repayment. People often fill both roles at once, but the law treats them separately, and a tax claim needs both.
Banks require every owner to be on the loan. Going the other way is optional, because a spouse or parent can be added purely to raise eligibility without owning part of the flat. Close relatives are the usual choices: spouses, parents and adult children.
Who Is Allowed to Claim
Each claimant must pass three tests:
- Listed as owner on the registered title deed
- Signed up as a borrower on the loan
- Paying a portion of the EMI out of personal income
A borrower missing from the deed gets nothing, since the benefit follows ownership. An owner who never pays an instalment is out as well. Proof is easy when the EMI leaves a shared account that both partners fund, or each partner's own account.
Caps and Section Numbers
A new Income-tax Act governs income from 1 April 2026, and home loan deductions have been renumbered. The ceilings are personal, so two eligible owners can claim twice over.
- Interest on a home you occupy: section 22, formerly 24(b), limited to Rs. 2 Lakhs per year
- Principal repaid, plus stamp duty and registration on buying: section 123, formerly 80C, limited to Rs. 1.5 Lakhs per year, which other approved investments also use
The interest ceiling holds if you acquire or complete the home within five years after the loan year closes. Pre-possession interest is spread over five equal years beginning with the completion year, under that same ceiling. A sale within five years after the possession year closes reverses the principal deduction.
Old Regime or New Regime
Only the old regime lets you use these. The new one, which applies by default, allows no deduction for interest on a home you occupy and none for principal. Work out tax both ways for each partner before assuming the benefit doubles.
A let-out flat is treated differently. Interest is netted against rent under either regime, and there is no set ceiling. Under the old regime, a house property loss can lower other income by up to Rs. 2 Lakhs yearly for each owner.
How to Split the Claim
Your claim moves with your ownership share and the money you actually paid. Where shares are equal and each partner funds half the EMI, each takes half the interest and half the principal. Claims above actual payment are not allowed.
Record the proportions on the deed in clear figures, say 60:40. If a deed lists two buyers without shares, assessment questions follow and a later sale gets harder. The lender issues one annual certificate for the whole loan, and each owner reports their part.
Borrowing Power and Interest Rates
A lender looks at the combined earnings of all borrowers after subtracting current EMIs, so two salaries can support a larger loan. It also checks every applicant's credit score. One poor score can push the rate up or trim the sanctioned amount.
Certain lenders cut the rate slightly when a woman is an owner and applicant. Karnataka charges women and men identical stamp duty and registration, so the duty is the same whoever is named. A high sanction is only a ceiling, so if one job is shaky, choose an EMI one income can carry.
Liability and Life Events
Borrowers on a joint loan are liable jointly and severally. The bank can collect the entire balance from either one, whatever the ownership proportions. If an instalment bounces, both credit histories show it.
Think through these situations in advance:
- A sale needs both owners to sign, and each reports a part of the capital gain
- After a separation, the loan runs until it is cleared or moved into a single name with the bank's consent
- If a borrower dies, the other keeps paying while the late owner's share goes to heirs or by will
A term policy on each earning borrower, equal to their portion of the loan, protects the home. A parent who joins just for income should realise their stake in the flat is part of their estate.
Doing the Paperwork in Order
Follow this sequence so deed, loan and payments match:
- Put both names, with shares, on the agreement for sale and the deed
- File the loan application jointly
- Pay the booking money and every instalment from accounts matching those shares
- Run the EMI through one shared account or split it over two accounts
- Obtain the interest certificate yearly and apportion it by share
- For a price of Rs. 50 Lakhs or above, TDS must be deducted on the purchase, each buyer reporting a part
In HSR Layout, Hebbal or anywhere else, agree the shares first. Changing them later needs a new registered deed and extra stamp duty.
