Prepaying a Home Loan in Bangalore: RBI Rules on Foreclosure Charges and Savings

A home loan is usually the biggest debt a household takes, and paying it down quicker can save a great deal of interest. Whether the lender can bill for that depends on the kind of interest rate and the kind of borrower. Here is how the RBI framework works, what early payments earn in rupees and what paperwork closes the matter.

Is a Fee Ever Payable?

For an individual with a benchmark-linked loan, the answer is that lenders may not charge for part-payments or for settling the whole outstanding amount. Fixed rate loans are not shielded, so a fee can be collected if the loan documents provide for it. A loan that begins at a fixed rate and later floats follows the rate that is live on the day of payment. Planning around that date can be worthwhile, since an extra payment after the switch to a floating rate costs nothing.

The Rule's Background

Since June 2012, banks have not been allowed to levy foreclosure charges on individuals who hold floating rate home loans. Housing finance companies and non-bank lenders have been subject to similar restrictions for years. Any loan sanctioned before 2026 is thus already covered.

On 2 July 2025, the central bank put these restrictions into new directions, which govern every loan sanctioned or renewed on 1 January 2026 or later. They state the following for an individual who borrows on a benchmark-linked rate for non-business use.

  • The fee is nil, irrespective of co-borrowers.
  • Both part-payment and complete closure are treated the same way.
  • Savings, a bonus or a loan from another lender are all treated the same way.
  • A lock-in is never permitted.
  • All regulated lenders must comply, from banks to housing finance companies.

The practical effect is freedom. Cash can go into the loan at any time of the year, and the lender has to take it without adding a fee.

Where Fees Can Be Applied

A fixed rate loan carries no such shield, and lenders may recover a charge under a policy their board has approved. The percentage is part of the contract, so it must be read before the agreement is signed. Many home loans have a fixed period of two or three years, followed by a floating period.

The directions give every borrower three safeguards. A charge is recoverable only if it is stated in the Key Facts Statement, the sanction letter and the agreement. A fee that has been waived cannot return later, and a lender that itself recalls a loan may not charge for it.

What Early Payment Saves

Interest is computed every month on the unpaid balance. That is why the early years carry the larger share of interest, and why money paid soon saves far more than money paid near the end. The illustration is a loan of Rs. 60,00,000 at 8.5% a year for two decades, with an EMI near Rs. 52,069, and a part-payment of Rs. 5,00,000 while the EMI is held steady.

TimingTerm shortened byInterest avoided
After 3 years35 monthsNearly Rs. 13,60,000
After 15 years14 monthsNearly Rs. 2,30,000

The rate is assumed constant at 8.5%. For other loan sizes and rates, the EMI calculator is the quicker tool.

Choosing Between Two Options

After a part-payment, borrowers are generally offered a choice between a shorter loan at the same instalment and an unchanged end date with a lighter instalment. For the example prepaid after three years, the smaller instalment is about Rs. 4,640 lower each month and the interest avoided is about Rs. 4,50,000. Holding the EMI steady saves about triple.

A household with a comfortable income may prefer the shorter term. One that wants flexibility every month may prefer the smaller EMI. Lenders apply different defaults when told nothing, so write the instruction down when the payment is made.

Think Before Prepaying

Prepaying earns a return equal to the loan's rate, a figure that safe investments rarely reach after tax. Still, a household should first hold half a year's expenses and instalments as a reserve. High-cost debts, including credit cards and personal loans, should be cleared ahead of the home loan, and health and term insurance should be in force.

Money needed in one or two years for a planned expense is best kept apart. The old tax regime allows an interest deduction capped at Rs. 2 Lakhs a year for a self-occupied home, whereas the new regime does not, so tax seldom favours keeping the loan.

Transferring the Loan

A floating rate loan can be ended at no charge, so a borrower paying a large spread may move to a lender with a smaller one. Expect a processing fee from the new lender, plus Karnataka stamp duty and registration on the new mortgage. Set the total against the savings in interest across the remaining term.

The present bank deserves a call first, because many will reduce the spread for a conversion fee that undercuts a transfer. Bringing a written offer from another lender strengthens the case.

Papers to Take Back at Closure

Closure is complete once the lender's claim has gone from every record where it was entered. Work through this list after the last payment.

  • Ask the lender for a statement of dues on the chosen date, and hold on to the receipt for the bank payment.
  • Obtain a closure letter and a certificate of no dues.
  • Recover the original sale deed and whichever other title documents the lender kept.
  • Have the mortgage discharged at the sub-registrar's office that recorded the deposit of title deeds.
  • Confirm that the CERSAI registry no longer shows the lender's charge.
  • See that the next encumbrance certificate and the credit report list the loan as closed.

Under an RBI rule that applies from 1 December 2023, lenders must return original documents and withdraw their charge within 30 days of the final payment. For delays that the lender causes, the borrower is paid Rs. 5,000 per day beyond that limit. Owners in Bangalore who expect to sell soon should finish this process first, because the next buyer's lender will ask for the documents.

Complaints About Fees

Begin with a letter to the lender's grievance officer, quoting the RBI directions, and allow 30 days for an answer. After that, a free complaint may go to the RBI Ombudsman through the Complaint Management System online.

Frequently Asked Questions

Will the bank bill me for repaying a floating rate home loan sooner?+
Not under RBI rules. An individual cannot be charged for part-payment or full closure of a home loan whose rate floats, and the source of the money makes no difference.
Are older loans covered by these rules?+
Yes. Since June 2012, banks have been unable to charge individuals on such loans. The 2025 directions, which apply from 1 January 2026, restate and extend the protection.
What happens with a fixed rate loan?+
A lender may charge if the loan agreement allows, and the charge must be stated in the Key Facts Statement, the loan agreement and the sanction letter. Fixed-then-floating loans follow the rate type on the payment date.
What saves more after a part prepayment, a shorter term or a smaller EMI?+
A shorter term does. On a loan of Rs. 60 Lakhs at 8.5%, a Rs. 5 Lakhs part-payment after three years saves around Rs. 13.6 Lakhs if the EMI stays, and around Rs. 4.5 Lakhs if the EMI falls.
When must the lender return the title papers?+
Within 30 days of the last payment. An RBI rule from 1 December 2023 makes the lender pay Rs. 5,000 a day for any delay that it is responsible for.
